What’s IMBRA
What is the purpose of IMBRA?
It was introduced in Senate (09/07/2005)
To regulate international marriage broker activity in the United States, to provide for certain protections for individuals who utilize the services of international marriage brokers, and for other purposes.
What is a Marriage Broker? (IMB)
The term “international marriage broker” (IMB) means a corporation, partnership, business, individual, or other legal entity, whether or not organized under any law of the United States, that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between United States clients and foreign national clients by providing personal contact information or otherwise facilitating communication between individuals from these respective groups.
Is Overseas Matchmakers and/or Destino Cupido (OM´s Partner site) an IMB? Based on the definition above, the answer is YES! We are, and we want to remain in full compliance with all industry regulations.
What are the IMB Obligations?
Before an IMB can release the personal contact information of a foreign client to a U.S. client, the IMB must:

Search the National Sex Offender Registry to determine the record of the U.S. citizen, and disclose any information found concerning the U.S. citizen to the foreign client. http://www.nsopr.gov

Obtain a signed statement from the U.S. citizen revealing any current or past protection or restraining orders, most criminal arrests and convictions, virtually all arrests or convictions for domestic or sexual offenses, multiple convictions for substance and/or alcohol abuse, the U.S. client’s marital history (including the reason for termination of any prior marriages), the ages of any of the U.S. citizen’s children under the age of 18, and a list of all States and counties in which the U.S. citizen has lived since the age of 18.

Distribute to the foreign national a pamphlet in Spanish, developed by the U.S. government, to educate foreign fiancé(e)s about U.S. domestic abuse laws and resources for immigrant victims in the United States.

Obtain the foreign national’s written consent to disclosing her personal contact information.
In other words, any U.S. citizen who uses the services of Overseas Matchmakers or Destino Cupido will not be able to communicate, by any means, with any foreign woman until she has received and acknowledged the U.S. client’s IMBRA disclosure file, received a copy of the government pamphlet explaining her rights in the U.S., and provided written authorization for the IMB to release her contact information.
However, to protect the women who place their trust in our agency, the IMBRA form on our site must be completed by every man who wishes to use our services, regardless of citizenship. There is simply no way around this requirement.
What are the IMBRA affected crimes?
IMBRA Disclosure Requirements
The International Marriage Broker Regulation Act (IMBRA) provides that a petitioner for a K nonimmigrant visa for a foreign fiancé(e) or spouse must submit, along with Form I-129F, detailed information regarding any criminal convictions (or attempts to commit) by the petitioner for any of the following specified crimes:

Domestic violence

Sexual assault

Child abuse and neglect

Elder abuse

Stalking

Homicide, murder, or manslaughter

Rape
-
Crimes involving controlled substances or alcohol where the petitioner has been convicted on at least three separate occasions and where such crimes did not arise from a single act

Abusive sexual contact

Sexual exploitation

Incest
-
Torture

Trafficking
-
Peonage
-
Holding hostage

Involuntary servitude

Slave trade
-
False imprisonment

Kidnapping, abduction, or unlawful criminal restraint
Important: Records must be disclosed even if they were sealed, expunged, or cleared, or if a judge, law enforcement officer, or attorney advised you that you no longer have a record.
What are IMBRA Requirements for a Visa?
• International Marriage Broker Regulation Act (IMBRA)
• Name of marriage broker, if applicable
• List of any prior petitions filed
• Convictions for any IMBRA specified crimes
